Crypto Recovery: BlockFi’s Bankruptcy Plan Snags

As the crypto bull run of 2023 pushes forward, the world of cryptocurrencies is not without its share of challenges and setbacks. BlockFi received conditional approval for its disclosure statement from the U.S. Bankruptcy Court in New Jersey, marking a significant step in the company’s reorganisation efforts and crypto recovery. However, this approval has not been without its critics, leading to objections from major players such as FTX, Three Arrows Capital, and the Securities and Exchange Commission (SEC).

Progress Amidst Obstacles

BlockFi’s continuous restructuring has achieved partial advancement as the U.S. Bankruptcy Court conditionally approved its declaration statement. This milestone signals a potential turning point for the crypto staking platform and crypto bank. The approval allows them to pursue their bankruptcy plan, which includes efforts to recover funds from defunct firms like Alameda Research, Three Arrows Capital, FTX, Emergent, Marex, and Core Scientific. These recovery efforts are crucial for BlockFi to restore financial stability and regain the trust of its investors and customers.

Crypto Arbitrage: Objections and Challenges

Despite the conditional approval, BlockFi’s proposed bankruptcy plan faces strong opposition from key players in the crypto industry. FTX, Three Arrows Capital, and the SEC have all voiced their objections. They raised objections, expressing worries that the proposal unfairly diminishes their rights, lacks procedural equity, and excessively pardons BlockFi and its leadership from legal obligations. Moreover, disputes over more than a billion dollars in transactions add further complexity to the situation. The liquidator of Three Arrows Capital, 3AC, is particularly assertive. 3AC revealed its plan in early July to reclaim $220 million of “preferential payments” given to BlockFi.
